Antimonopoly Committee opens case against MHP

The Antimonopoly Committee has opened an investigation against the MHP agricultural holding, ProAgro Group reports referring to the AMCU information.

It is noted that from the publications in the media the Committee became aware of the purchase of “Lubnymyaso” by the holding and therefore it checked compliance with the legislation on protection of economic competition in the implementation of the transaction.

After the inspection the Antimonopoly Committee established that the purchase of assets of “Lubnymyaso” by MHP should have taken place only with the prior approval of the Committee.

“Since the concentration participants did not apply for this permission on their own initiative, the Committee began to consider the case on the fact of violation of legislation on protection of economic competition by MHP, – notes the antimonopoly committee.

Earlier, in June 2019, the AMCU began an investigation into the actions of MHP group (5 poultry farms and MHP Company) on the chicken market. At that time it was said that the agricultural holding practices restrictive trade policy in relation to distributors, sub-distributors and partners, which can lead to disruption of the structure of the chicken distribution market, significantly limiting the rights of other market participants to freely choose their partners.
